Agreement between User and PlaygroundParkbench, LLC

Welcome to PlaygroundParkbench, LLC’s web site.  By using PlaygroundParkbench.com, you agree to the following terms and conditions.  We take your privacy very seriously.  Our privacy policy can be reviewed here.

Eligibility
You must be at least 18 years old to register and use PlaygroundParkbench.com

User Accounts
To use some features on PlaygroundParkbench.com, you are required to register for an account, providing us with personal information.  You are responsible for any activity, including all comments or posts, that occurs from your accout.  PlaygroundParkbench, LLC reserves the right to suspend your account at any time for any or no reason.  There are two types of user accounts:

A “Member Account” is an account for your personal use only.  You may not impersonate someone else, provide an email address for someone other than yourself, or create multiple Member Accounts.

A “Partner Account” is an accout to be used solely for the purpose of representing a business or organization on PlaygroundParkbench.com.  In creating, updating or posting from a Partner Account, you must be an authorized representative of the business or organization.  You may not impersonate or create an account for a business or organization you are not a representative of, provide an email address for someone other than yourself, or create multiple business accounts for the same business.

Acceptable Use
You are responsible for the content you post on PlaygroundParkbench.com and for the content sent to its users.  By using our site, you agree that you will not hold PlaygroundParkbench, LLC responsible or liable for any content you access from other users on the site.

We created PlaygroundParkbench.com to share information and opinions among parents  about fun things to do in your local community.  We encourage you to be an active member of the PlaygroundParkbench.com community and share your opinions freely.  However, the following uses for the site are not acceptable and will not be allowed.  You agree that you will not use PlaygroundParkbench.com:

1.  To threaten, stalk, defraud, or harrass another person, business or organization, or otherwise interfere with another user’s use of our site.

3.  In a way that is disingenuous or may create a conflict of interest, including but not limited to, trading reviews with other businesses or asking members to write reviews in exchange for compensation

4.  To promote bigotry or discrimination

5. To submit or transmit pornography or any obscene or illegal content

6.  To solicit personal information from or about minors or to harm or threaten to harm minors

7.  To reformat or frame any portion of the site

8.  To attempt to gain unauthorized access to the site, user accounts, systems or networks connected to PlaygroundParkbench, LLC via hacking, password mining or any other means

9.  To submit content that you know to be false, inaccurate or misleading

10.  To infringe any third party’s copyright, patent, trademark, trade secret or other proprietary rights or rights of publicity or privacy

11.  To violate any law, statue, ordinance or regulation (including without limitation those governing export control, consumer protection, unfair competition, anti-discrimination or false advertising)

12.  To create liability for PlaygroundParkbench, LLC, or cause us to lose (in whole or in part) the services of our Partner Accounts or other suppliers

Permission to Use Your Content
You agree that any and all information and content that you provide to our site becomes the exclusive property of PlaygroundParkbench, LLC, and you irrevocably assign all rights of ownership, including, without limitation, intellectual property rights, to PlaygroundParkbench, LLC upon submission of the information and content.  You represent and warrant that you are the owner of such information and content and are authorized to make such assignment of rights.  We may use this content in various ways.  This content may include any information or comments posted by you, affiliated with your registration and user profile, not including any personally identifiable information), or content sent to our site as a suggestion, opinion or email.  This content may be used in the following ways, but not limited to: display on other areas of PlaygroundParkbench.com; in press releases; for promotional purposes; other media outlets to repurpose it.

By agreeing to our Terms and Conditions, you are giving PlaygroundParkbench, LLC and other media permission to  use your content for any purpose.

Warranties, Disclaimers, and Limitations of Liability
PlaygroundParkbench, LLC makes no warranties of any kind.

PlaygroundParkbench, LLC disclaims all liability for any damages out of personal or business use, , including upgraded Partner Accounts or advertising, of PlaygroundParkbench.com.  Jurisdictions not allowing for the exclusion of warranties, will apply the law regarding warranties in those jurisdictions.

The maximum liability for any causes will be limited to the amount paid within the most recent twelve month period.

Third Parties and Affiliate Links
Our site may include links to other websites.  We do not control or endorse any Third Party site or content, and you agree that we are not responsible for the availability or contents of Third Party sites.

Our site also includes affiliate links to other websites.  We receive compensation when Users click on, and subsequently purchase from, our affiliate links.  This compensation helps defray the cost of maintaining and producing PlaygroundParkbench, LLC.
